Terms & Conditions

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("you", "user") and Nostal ("Nostal", "we", "us", "our") governing your access to and use of the Nostal mobile application and related services (collectively, the "Services"). By accessing or using the Services, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must not access or use the Services.

1. Eligibility

1.1 Age Requirement

The Services are not intended for individuals under 13 years of age. By using the Services, you represent that you are at least 13 years old. If you are under 18, you confirm that you have obtained parental or legal guardian consent.

1.2 Legal Capacity

You represent that you have the legal capacity to enter into these Terms under applicable law.

1.3 Compliance With Law

You agree to use the Services only in compliance with all applicable laws, rules, and regulations of Pakistan and any jurisdiction from which you access the Services.

2. Nature of the Services

Nostal is a photo-sharing social media platform that allows users to upload photos, interact with other users, and participate in engagement-based and referral-based features. The Services are provided for personal, non-commercial use only, unless expressly authorized by Nostal in writing.

3. Account Registration and Security

3.1 Account Creation

To access certain features, you must create an account and provide accurate, complete, and current information.

3.2 Account Responsibility

You are solely responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activities conducted through your account

3.3 Account Restrictions

You may not:

  • Create multiple accounts without permission
  • Transfer or sell your account
  • Access another user's account

4. User Content

4.1 Ownership

You retain ownership of all photos and content you upload ("User Content").

4.2 License to Nostal

By uploading User Content, you grant Nostal a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, display, reproduce, and distribute such content solely for operating and improving the Services.

4.3 Visibility

You acknowledge that content shared publicly may be viewed, shared, or interacted with by other users, and Nostal does not control third-party use of such content.

5. Prohibited Content and Conduct

You agree not to upload, post, or engage in content or behavior that:

  • Violates any law or regulation
  • Infringes intellectual property or privacy rights
  • Is pornographic, sexually explicit, or exploitative
  • Involves minors in harmful or sexualized content
  • Is hateful, violent, defamatory, or deceptive
  • Promotes scams, fraud, or illegal schemes
  • Interferes with the operation or security of the Services

6. Tokens, Rewards, and Referrals

6.1 No Token Issuance

Nostal does not currently issue any token. Any reference to future tokens is informational only and non-binding.

6.2 No Financial Representation

Nothing on the Services constitutes:

  • A financial instrument
  • An investment offer
  • A promise of monetary value

6.3 Referrals

Referral programs may be offered, modified, or discontinued at any time. Rewards are discretionary, non-transferable, and subject to eligibility rules.

7. Intellectual Property

All platform software, branding, design, features, and non-user content are owned by Nostal or its licensors. You may not copy, modify, distribute, reverse-engineer, or exploit any part of the Services without prior written consent.

8. Third-Party Services

The Services may integrate with third-party platforms (e.g., Apple, Google). Nostal is not responsible for third-party services, content, or practices. Your use of third-party services is governed by their respective terms.

9. Suspension and Termination

Nostal may suspend or terminate your account at any time, with or without notice, if you violate these Terms or pose risk to the platform or other users. Upon termination:

  • Your access to the Services ceases
  • Content may be removed or rendered inaccessible
  • Certain provisions of these Terms survive termination

10. Disclaimer of Warranties

The Services are provided "AS IS" and "AS AVAILABLE". Nostal disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, reliability, or availability.

11. Limitation of Liability

To the maximum extent permitted by law, Nostal shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Services. Nostal's total liability shall not exceed the greater of:

  • PKR 10,000, or
  • The amount you paid (if any) to Nostal in the preceding 12 months.

12. Indemnification

You agree to indemnify and hold harmless Nostal, its officers, employees, and affiliates from any claims, damages, losses, or expenses arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your content or conduct

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Islamic Republic of Pakistan. You agree that any dispute shall be subject to the exclusive jurisdiction of the competent courts of Pakistan.

14. Changes to the Terms

Nostal may modify these Terms at any time. Updated versions will be made available within the Services. Continued use constitutes acceptance.

15. Severability

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Nostal regarding the Services and supersede all prior agreements or understandings.
